Insurance and Defense Litigation

The Insurance and Defense Litigation Practice Group provides coverage advice, defense services and claims administration services to insurers regarding defense of claims and analysis of coverage questions under a variety of different policy forms.

We advise our insurance clients on how to respond to claims and assist with reservation of rights letters and non-waiver agreements. We represent our insurance clients in declaratory judgment actions arising from disputes over coverage issues. The Practice Group advises on “claims made” and “occurrence” policies including casualty, property, professional, and uninsured motorist coverage. We advise insurance clients on arson and subrogation issues. We defend bad faith and other insurance coverage dispute suits against carriers.

We provide representation to self-insured parties and carriers and their insured parties in all Vermont State, Federal State, and Federal Courts. We handle our cases efficiently while following total quality management principles. And we use alternative dispute resolution where advantageous to our clients. We’re supported by internal and networked research sources.

We also have experience handling complex and multi-party litigation including motor vehicle liability, products liability, premises liability, infectious disease, and toxic tort litigation, including pre-suit investigation and case evaluation support to clients.

Professional Liability Defense

We have experience litigating professional liability claims including defense of lawyers, real estate agents and brokers, architects and engineers, medical facilities (nursing homes, residential care facilities, and dental clinics) and accountants.

We maintain internal resources dedicated to the defense of the same and have access to external comprehensive research support services. We follow a structured approach to the defense, assessment and evaluation of claims to carriers and their insured parties.
